Terms & Conditions

Article 1 : Application and modification
The online shop www.bulb-x.com was set up and is run by the company Bulb-x, located at Place St-Martin 11, Postbox 1058, 1260 Nyon, Switzerland and registered at the Registre du Commerce du canton de Vaud under the number CH-550-1050983-1.
All purchases made via www.bulb-x.com assume that the customer has read and accepted these Terms & Conditions. Bulb-x has the right to modify these Terms & Conditions at any time. In such case, the Terms & Conditions in effect on the day of the purchase will be applied. For our part, we will do our best to communicate fully to our customers the following information :

• A detailed description of all the produits available on our website
• The price in Swiss francs (CHF) and in euros (EUR) of every product
• All available methods of payment as well as delivery terms and costs

Article 2 : Totality
These Terms & Conditions express the totality of the obligations of the parties involved (buyer & seller). Therefore, it is assumed that the customer has fully accepted and without condition all of the articles included in these Terms & Conditions.
In addition, the present Terms & Conditions take precedence over any other terms or conditions not specifically and clearly accepted by Bulb-x.

Article 3 : Information about the products
The products on sale are those that appear on the website www.bulb-x.com.
They are available as long as Bulb-x has them in stock. A detailed description and at least one picture of each product is available online. The pictures provided reflect as best as possible the real aspect of the products. However, given the nature of the products on sale (i.e. bulbs) the pictures are not necessarily a perfect reflection of reality.
The products, pictures and advertising documents on paper or on our website can be modified by us at any time and without prior notice. In such a case, we will not be required to supply any product that is no longer advertised on the website.

Article 4 : Electronic signature
The customer’s "click" on the button that confirms his/her purchase constitutes an electronic signature, which between the buyer and the seller has the same value as a handwritten signature.

Article 5 : Prices
Prices on the website www.bulb-x.com are given in Swiss francs (CHF) and in euros (EUR) and are applicable only until the date of purchase by the customer. They do not include the cost of shipping, which are billed in addition to the sale price.
Prices include the value added tax (VAT) applicable on the day of purchase and any change in the VAT rate will automatically be taken into account in prices on the website.
Bulb-x reserves the right to change prices at any time. However, the only price applicable will be the one mentioned on the website on the day of purchase.

Article 6 : Methods of payment and security
For the payment of his/her purchase, the customer can choose one of four different methods :

1. Visa or Mastercard credit card
2. Bank transfer
3. Paypal
4. Invoice payable within 20 days after delivery. This option is available only for customers living in Switzerland and for purchases not exceeding CHF 100.- (all costs included).

When validating his/her payment, the customer guaranties to Bulb-x that s/he has the necessary authorisation and financial means to use the chosen method of payment.
The company Bulb-x has the right to suspend or cancel any order or delivery of goods in case of :

• a payment refusal coming from an official credit card company ;
• non-payment of the order by the customer ;
• previous unresolved litigation between the parties.

Payments made by credit card will be processed via a secured system using the SSL (Secure Socket Layer) protocol. All sensitive information will therefore be encrypted and no unauthorised person will have access to that information during its transfer via the internet.
Bulb-x will inform the customer by email of all recorded orders and payments.

Article 7 : Delivery
7a. Geographical zones of delivery
The online purchase of goods from the website www.bulb-x.com is limited to persons or companies located either in Switzerland or in a country of the European Union.
7b. Delivery costs
Delivery costs are calculated according to the delivery address and to the weight of the order.
7c. Delivery time
For deliveries in Switzerland, delivery time should not exceed 5 working days after the date of the order.
For deliveries to a country of the European Union, delivery time should not exceed 10 working days after the date of the order.
No unexpected event or cause beyond control can justify the cancellation of an order, the refusal to accept ordered goods or the application of any kind of penalty or rebate.
7d. Damage during delivery
We decline all responsibility in the case of damage to goods incurred during delivery and/or caused by the transporter.

Article 8 : Complaints, returned goods
The customer is responsible for checking that the goods received correspond to his/her order.
All complaints by the customer must be sent to Bulb-x in writing and within 48 hours of receiving the goods.
No returned goods will be accepted without the prior consent of Bulb-x. Goods must be returned in their original packaging and at the expense of the customer. Bulb-x declines all responsibility in case of loss or damage to returned goods.

Article 9 : Warranty
Bulb-x bulbs have a warranty of 12 months after the date of purchase. During the warranty period and in case of failure of the bulb to function normally, the customer can return the bulb (at his/her own cost) to Bulb-x and it will be replaced free of charge. The warranty is applicable only to damaged bulbs that were used in so-called “normal” conditions, i.e. within a temperature range of 0 to 40°C and in a closed lighting device when used outside.

Article 10 : Applicable law
These Terms & Conditions are subject to Swiss law. In the case of a complaint or litigation, the customer will first contact the company Bulb-x in order to try to settle the matter without going to court. If such a settlement is not possible, the customer can file a complaint with the Swiss courts.

Article 11 : Liability
During the online sale process, Bulb-x cannot be held responsible for any problem resulting from the internet or the customer’s connexion to the internet, such as loss of data, virus attack, hacking or any other unexpected event.

Article 12 : Intellectual property
All the elements of the website www.bulb-x.com are and remain the sole intellectual property of the company Bulb-x. Nobody is authorised for any reason to reproduce, use or distribute any element or partial element of the website, be it a program, a visual effect or a sound without the prior and written consent of Bulb-x. All links and hyperlinks from www.bulb-x.com to another website or from another website to www.bulb-x.com are strictly forbidden without the prior and written consent of Bulb-x.

Article 13 : Data of a private nature
All the data requested from the customer during the online sale process is necessary for the processing of the order and can be communicated exclusively to the contractual partners of Bulb-x who play a role in the execution of the order. Customers can write to Bulb-x to exercise their right of access to, and correction of the data concerning them and held within the database of Bulb-x.
